Pricing may change when:

- Work is delayed and later resumed under substantially different conditions
5. Client Service Agreements Control

When a client hires BTB Web Designs, the project may also be governed
by one or more written documents, including:

- A statement of work
- A service agreement
- A maintenance or hosting agreement
- An estimate or invoice
- A project-change authorization

If a project-specific written agreement conflicts with these general

6. Client Responsibilities
Clients are responsible for providing accurate, complete, and
timely information reasonably required to perform the agreed work.
Client responsibilities may include:

- Providing approved text, images, logos, videos, product information, and other content
- Reviewing work and providing clear feedback within the requested timeframe
- Obtaining permission to use all submitted content and intellectual property

- Maintaining secure passwords and protecting account credentials
- Reviewing the website for factual, legal, pricing, spelling, and contact-information accuracy
- Approving completed work before publication or launch
- Complying with laws and industry requirements applicable to the client’s business
- Paying agreed fees and third-party costs when due
Project schedules and results may be affected when the client does
not provide requested information, content, access, decisions,
approvals, or payments in a timely manner.
Clients should use secure methods when sharing passwords and should
change temporary or shared credentials after project completion
whenever appropriate.
7. Client Content and Legal Compliance
Clients retain responsibility for the accuracy, legality, and
ownership of content supplied to BTB Web Designs.
By providing content, files, access, instructions, trademarks,
photographs, videos, product information, testimonials, customer
data, or other materials, the client represents that:
- The client owns the material or has permission to use it
- The material does not unlawfully infringe another party’s rights
- The material is not knowingly false, deceptive, defamatory, or illegal
- The requested use complies with applicable agreements and laws
BTB Web Designs is not responsible for independently verifying every
factual statement, license, permission, trademark, image right,
copyright, product claim, testimonial, or legal disclosure supplied
by a client.
We reserve the right to refuse or discontinue work involving content
or conduct that we reasonably believe is unlawful, deceptive,
abusive, infringing, malicious, or outside our professional standards.
8. Project Scheduling, Delays, and Inactive Projects
Project schedules are estimates unless a written agreement expressly
identifies a guaranteed deadline.
Completion dates may be affected by:
- Delayed client responses or approvals
- Missing content, credentials, or technical access
- Changes in project scope
- Third-party platform limitations or outages
- Software conflicts or previously unknown website problems
- Domain, hosting, DNS, email, or account-transfer delays
- Emergencies, illness, severe weather, or circumstances beyond reasonable control
Projects that remain inactive because required client materials,
responses, payments, or approvals have not been received may be
paused, rescheduled, archived, or subject to a restart fee when
permitted by the applicable project agreement.
9. Revisions and Scope Changes
The number and type of revisions included in a project will be
determined by the applicable proposal, invoice, statement of work,
or service agreement.
A revision generally means a reasonable adjustment to work already
created within the approved project scope. A request may be treated
as additional work when it involves:
- A new design direction after prior approval
- Additional pages or services
- New functionality or integrations
- Major restructuring of completed work
- Replacement of previously approved content
- Changes caused by inaccurate or incomplete client instructions
- Work outside the original project scope
Additional work may require a revised estimate, change order,
separate invoice, or written authorization.
10. Payments, Deposits, and Third-Party Fees
Project fees, deposits, payment schedules, recurring charges, and
due dates will be stated in the applicable proposal, agreement, or
invoice.
Unless otherwise agreed in writing:
- Required deposits must be paid before work is scheduled or begins
- Invoices are due according to the terms shown on the invoice
- Final payment may be required before website launch, transfer, or delivery of final files
- Work may be paused when an invoice becomes overdue
- Recurring services may be suspended or discontinued for nonpayment
- Previously completed work remains billable even if the client later changes direction
Third-Party Costs
Unless specifically included in writing, project pricing does not
automatically include third-party costs such as:
- Domain registration or renewal fees
- Website hosting
- Premium plugins, themes, extensions, or software
- Stock photography, video, music, fonts, or licensed assets
- Email, CRM, scheduling, analytics, or marketing platforms
- Advertising budgets and platform charges
- Payment-processing fees
- External development, legal, writing, or professional services
Clients are responsible for approved third-party charges and for
maintaining services necessary for their website’s continued
operation.
Refunds and Cancellations
Refund and cancellation rights, if any, are determined by the
applicable proposal, agreement, invoice, and work already performed.
Payments for completed work, reserved project time, purchased
licenses, domain registrations, hosting, advertising costs, and
other nonrecoverable expenses may be nonrefundable.
11. Intellectual Property
BTB Website Content
Unless otherwise stated, the BTB Web Designs name, logos, branding,
website design, written content, graphics, service descriptions,
page layouts, custom code, case studies, and other original materials
appearing on this website are owned by or licensed to BTB Web Designs.
You may view and print limited website content for your own lawful,
noncommercial reference. You may not reproduce, republish, sell,
license, distribute, modify, frame, scrape, or commercially exploit
our website content without prior written permission.
Client Project Ownership
Ownership of client project deliverables will be determined by the
applicable written project agreement.
Unless otherwise agreed in writing, transfer of ownership rights in
final custom deliverables is conditioned upon full payment of all
amounts due for the project.
Third-party components remain subject to their original licenses and
are not transferred as exclusively owned client property. These may
include:
- WordPress
- Divi and other themes
- Plugins and extensions
- Stock photographs and licensed media
- Fonts
- Open-source code
- Software libraries
- Hosted platforms and external services
Reusable Knowledge and Tools
Unless otherwise agreed in writing, BTB Web Designs retains ownership
of its preexisting materials, general methods, processes, templates,
utilities, development techniques, reusable code, know-how, and tools
used to provide services.
The client receives only the rights expressly granted in the applicable
service agreement.
12. Portfolio and Promotional Use
Unless restricted by a written confidentiality agreement or
project-specific agreement, BTB Web Designs may identify publicly
launched work as part of its portfolio and may display:
- The client’s business name
- The publicly available website address
- Website screenshots
- General descriptions of services performed
- Publicly available results or project outcomes
We will not intentionally publish confidential credentials,
nonpublic business information, customer data, or information that
we have agreed in writing to keep confidential.
Clients may request reasonable limitations on portfolio use before
the applicable project agreement is finalized.
13. Third-Party Products and Services
Websites often depend on services operated by third parties,
including:
- Domain registrars
- Website-hosting companies
- Content-delivery networks
- WordPress themes and plugins
- Email providers
- Payment processors
- Analytics and advertising platforms
- Search engines
- Social-media platforms
- Security, backup, and spam-prevention services

These products and services are controlled by their respective
providers and are subject to their own terms, pricing, privacy
practices, availability, updates, and technical limitations.
BTB Web Designs does not control and is not responsible for:

- Account suspensions imposed by another provider
- Changes to search-engine or advertising-platform algorithms

14. Hosting, Maintenance, and Website Security
Hosting, maintenance, monitoring, backups, software updates, malware
removal, and security services are provided only when expressly
included in an active paid agreement.
The completion of a website project does not automatically create
an ongoing obligation to:
- Host the website
- Install future updates
- Monitor uptime or security
- Repair future software conflicts
- Renew licenses or domain registrations
- Maintain backups
- Provide unlimited technical support
No website or server can be guaranteed to be completely secure,
continuously available, or immune from hacking, malware, data loss,
software failures, human error, or third-party attacks.
Clients who do not maintain an active maintenance or hosting plan
remain responsible for ongoing software updates, backups, security,
account renewals, and website administration.
15. No Guarantee of Specific Results
BTB Web Designs will use reasonable professional care when performing
agreed services. However, unless expressly guaranteed in a written
agreement, we do not guarantee any specific business, marketing,
technical, financial, or search-engine result.
We do not guarantee:
- A specific Google or search-engine ranking
- A specific amount of website traffic
- A specific number of leads, calls, or sales
- Acceptance or approval by Google or another platform
- Continuous website availability
- Complete prevention of hacking or malware
- Compatibility with every browser, device, plugin, or future update
- That every accessibility or legal requirement has been identified
- That recommendations will produce identical results for every business
SEO, advertising, conversions, website performance, and business
results depend on many factors outside our control, including market
conditions, competition, client participation, pricing, reputation,
content, website history, platform changes, and user behavior.
16. Accessibility and Legal Review
BTB Web Designs may apply recognized website-accessibility and
usability practices when included in the agreed scope. However,
unless expressly stated in a written agreement, our services do not
constitute a formal accessibility certification, compliance audit,
or legal opinion.
Clients are responsible for determining which laws, regulations,
privacy disclosures, industry standards, accessibility requirements,
and contractual obligations apply to their businesses.
Clients should consult a qualified attorney or other appropriate
professional regarding legal compliance, regulated industries,
privacy requirements, accessibility obligations, warranties,
disclaimers, refund policies, terms of service, and other legal
documents.
17. Confidential Information
Each party may receive confidential or nonpublic information during
a project. The receiving party agrees to use reasonable care to
protect confidential information and to use it only for legitimate
project and business purposes.
Confidential information does not include information that:
- Is publicly available through no breach of an obligation
- Was lawfully known before disclosure
- Is received lawfully from another source without a confidentiality restriction
- Is independently developed without use of the confidential information
- Must be disclosed under a lawful court order or legal requirement
Additional confidentiality requirements should be included in a
separate written agreement when sensitive client data, trade secrets,
regulated information, or substantial proprietary information will
be involved.
18. Backups and Data Loss
Unless an active written agreement expressly assigns backup
responsibility to BTB Web Designs, clients are responsible for
maintaining current copies of their website files, databases,
content, account information, and other important data.
When BTB Web Designs provides backup services, backups remain subject
to storage limitations, retention schedules, software errors,
hosting conditions, and other technical risks.
No backup system should be treated as infallible. Clients should
maintain independent copies of essential business data whenever
reasonably possible.
19. Suspension or Termination of Services
Subject to any applicable written agreement, BTB Web Designs may
suspend, refuse, or terminate services when:
- An invoice remains unpaid
- The client repeatedly fails to provide required information or access
- The requested work becomes unlawful, deceptive, abusive, or unsafe
- The client misuses systems, credentials, services, or third-party platforms
- The client materially breaches an agreement
- Continued work would expose BTB Web Designs or another party to unreasonable risk
- The working relationship becomes threatening, abusive, or professionally unworkable
Termination does not eliminate obligations relating to outstanding
payments, licensed materials, confidentiality, intellectual property,
indemnification, or other provisions intended to survive termination.
20. Disclaimer of Warranties
To the fullest extent permitted by applicable law, this website and
its content are provided on an “as is” and “as available” basis.
BTB Web Designs disclaims warranties regarding the public website,
